Letter to West Bengal CM
Dear Mamataji,
You must have learnt that the Chief Minister of Maharashtra has ordered the suspension of the police officers who ordered the arrest of the Mumbai girl who posted on Facebook her objection to the shutdown of Mumbai on the death of Bal Thackeray.
I request you to do the same to the policemen who ordered and implemented the arrest of Prof. Mahapatra of Jadavpur University and Siladitya Choudhari, and you should immediately withdraw the cases against them and apologize to them.You should also immediately restore Damyanti Sen, the upright police officer, whom you wrongly victimized,and you should openly apologize to her for your wrong. We are all human beings and we all make mistakes, but a gentleman is one who realizes his mistake and apologizes. You should also apologize to Tanya Bharadwaj whom you insulted on the CNN IBN show.
I can assure you that if you do so you will go up in the esteem of the people of West Bengal, and indeed the whole country.
From what I could gather during my visits to Kolkata, your Ministers and bureaucrats are afraid to speak out their minds fearlessly before you, and are terrorized by your unpredictable and whimsical behaviour. To say the least, this is a very unhealthy state of affairs, and you will not be able to remain as Chief Minister for long unless you change your ways and become more tolerant.
Kautilya has said in the Arthashastra that a successful ruler is one who appoints good advisers, and listens to their advice. Of course, after listening to their advice it is ultimately for you to take the final decision, but your advisers should feel free to express their opinions fearlessly. In this connection I may mention that Sardar Patel, the first Union Home Minister, told his Secretaries (senior I.C.S. officers ) that they should express their views freely, even if their view is totally different from his own, and he would never take offence. In fact if they do not express their views freely they were of no use to him. This is the way you should also conduct yourself.
It is still not too late for you if you listen to my advice and change your ways. I am your well wisher, and would like you to do well, and in fact, if you remember, I had praised you at one time. But of late you seem to have become increasingly intolerant and whimsical, which is only going to land you in big trouble.

কার্টুন কাণ্ড-এ অধ্যাপক অম্বিকেশ মহাপাত্রকে গ্রেফতারের ব্যাখ্যা চেয়ে রাজ্য সরকারকে নোটিস পাঠাল সুপ্রিম কোর্ট। ছয় সপ্তাহের মধ্যে শীর্ষ আদালতকে রিপোর্ট পাঠাতে হবে। শুধু পশ্চিমবঙ্গকেই নয়, মহারাষ্ট্রের পালগরে বাল ঠাকরের শোকজ্ঞাপন সংক্রান্ত ফেসবুক পোস্ট নিয়ে দুই তরুণীর গ্রেফতার হওয়ার ঘটনারও ব্যাখ্যা চেয়েছে সর্বোচ্চ আদালত। এছাড়াও পুদুচেরি, তামিলনাড়ু ও দিল্লির কাছেও তথ্য প্রযুক্তি আইনে গ্রেফতারের একাধিক ঘটনার ব্যাখ্যা চাওয়া হয়েছে।
গতকালই ২০০০ সালের তথ্য প্রযুক্তি আইনের ৬৬ এ-র ধারার কড়া সমালোচনা করে সুপ্রিম কোর্টের প্রধান বিচারপতি আলতামাস কবীর বলেন, "যে ভাবে অল্পবয়সীদের গ্রেফতারের ঘটনা ঘটছে তাতে দেশের ভাবাবেগ গুরুতর আহত।" তিনি আরও বলেন এই ঘটনা যেন না ঘটে তা নিয়ে ভাবার সময় এসেছে। এ দিনই দিল্লির এক আইনের ছাত্রী শ্রেয়া সিংঘল সুপ্রিম কোর্টে একটি জনস্বার্থ মামলা দায়ের করেন। তাতে বলা হয় তথ্য প্রযুক্তির ৬৬ এ ধারাটি অসাংবিধানিক এবং মত প্রকাশের স্বাধীনতার পরিপন্থী।
সাম্প্রতিককালে তথ্য প্রযুক্তি আইনে গ্রেফতার হওয়ার বেশ কিছু ঘটনা সারা দেশে সমালোচনার ঝড় তুলেছে। চলতি মাসেই মহারাষ্ট্রে বাল ঠাকরের মৃত্যুতে শোকজ্ঞাপনে মহারাষ্ট্র স্তব্ধ হয়ে যাওয়ার যৌক্তিকতা নিয়ে প্রশ্ন করায় গ্রেফতার হন ২১ বছরের শাহীন ধাদা ও তাঁর বান্ধবী রিনু শ্রীনিবাসন। দেশ জুড়ে এই ঘটনার প্রতিবাদ হয়। চাপে পড়ে রাজ্য সরকার ঘটনায় জড়িত দুই পুলিস অফিসারকে সাসপেন্ডে করে।
মহারাষ্ট্রের ঘটনায় জড়িত পুলিস অফিসারের সাজা হলেও পশ্চিমবঙ্গে কার্টুনকাণ্ডে জড়িতদের বিরুদ্ধে এখনও কোনও ব্যবস্থা নেওয়া হয়নি। চলতি বছরের এপ্রিলে যাদবপুর বিশ্ববিদ্যালয়ের রসায়ন বিভাগের অধ্যাপক অম্বিকেশ মহাপাত্র ফেসবুকে নিছক একটি ব্যাঙ্গচিত্র ছড়ানোর `অপরাধে` গ্রেফতার হন। জামিনযোগ্য ধারায় গ্রেফতার হলেও সারারাত হাজতবাস করতে হয় তাঁকে। মানবাধিকার কমিশনও এই গ্রেফতারের বিরুদ্ধে সোচ্চার হয়। তবে গ্রেফতারকারী পুলিসদের বিরুদ্ধে শুধুমাত্র কোনও ব্যবস্থা নেওয়া হয়নি তাই নয় তাঁদের অতিসক্রিয়তা প্রশংসিত হয়েছে মহাকরণের অলিন্দেও।
তথ্য প্রযুক্তি আইনের ৬৬ এ ধারা অনুযায়ী যোগাযোগ ব্যবস্থার মাধ্যমে আক্রমণাত্মক, বিরক্তি উদ্দীপক, বিপদ ছড়ানো, অপমানকর, ভাবাবেগে আঘাত করতে পারে এমন, অপরাধমূলক ভীতিপ্রদর্শন, ঘৃণা, বিদ্বেষমূলক বার্তা ছড়ালে গ্রেফতার করা হবে বার্তা প্রেরককে।
কেন্দ্রীয় সরকারের তরফে অ্যাটর্নি জেনারেল সুপ্রিম কোর্টকে জানিয়েছেন, আইনটির অপব্যবহার রুখতে বিশেষ কিছু ব্যবস্থা গ্রহণের কথা ভাবা হচ্ছে।

সুপ্রিম কোর্টে বহু বিতর্কিত সিঙ্গুর মামলার শুনানি হবে আগামী সোমবার। কলকাতা হাইকোর্ট সিঙ্গুর আইনকে অসাংবিধানিক আখ্যা দেওয়ার পর, সুপ্রিম কোর্টে আপিল করেছিল রাজ্য সরকার। সেই আবেদনের ভিত্তিতেই সিঙ্গুর নিয়ে নিজেদের অবস্থান স্পষ্ট করবে টাটারা। এর পাশাপাশি, কোন পরিস্থিতিতে টাটারা রাজ্য ছেড়েছিল, সুপ্রিম কোর্টে সেই যুক্তিও পেশ করতে পারেন টাটাগোষ্ঠীর আইনজীবী।
প্রসঙ্গত, সিঙ্গুর আর নন্দীগ্রাম ইস্যুকে কেন্দ্র করেই এ রাজ্যে রাজনৈতিক পটভূমির পরিবর্তন হয়েছিল। ক্ষমতায় আসার পর তৃণমূল সরকারের যে সিঙ্গুর আইন প্রণয়ন করে হাইকোর্ট তাকে অসাংবিধানিক আখ্যা দেওয়ায় ব্যাকফুটে চলে যায় রাজ্য সরকার।
এদিকে সিঙ্গুরের অনিচ্ছুক চাষীরাও বহু দিন পর সরকারের বিরুদ্ধে এখন ক্ষোভ প্রকাশ করছেন। যে সিঙ্গুরের জমি আন্দোলন কে কেন্দ্র করে মমতা সরকারের জন সমর্থনের ভিত্তি তৈরি হয়েছিল, জমি ফেরত দিতে না পারায় তাও এখন প্রশ্নের মুখে। এ রকম পরিস্থিতিতে সোমবার সুপ্রিম কোর্টের রায়ের দিকে তাকিয়ে থাকবে সিঙ্গুর সহ গোটা দেশ

Mamata can’t last long as Chief Minister: Katju
“Mamata Banerjee cannot last long as Chief Minister, as the people of West Bengal will not tolerate her dictatorial tendencies,” Markandey Katju, chairperson of the Press Council of India, told The Hindu on the telephone from New Delhi on Thursday.
In a message to Ms. Banerjee late on Wednesday night, through e-mail to the State’s Information Secretary Nandini Chakravorty, Justice Katju pointed out that during his recent visits to the city, he had learnt that Ministers and officials “are afraid to speak their minds” and are “terrorised” by her “unpredictable and whimsical behaviour.”
“This is a very unhealthy state of affairs and you will not be able to remain as Chief Minster for long unless you change your ways and become more tolerant,” he wrote.
Asked by journalists for her comments, Ms. Banerjee said that she had not received any letter and would not comment in this regard.
When it was pointed out by this correspondent that Ms. Banerjee had said at an event earlier in the day that it did not matter what her critics said, Justice Katju retorted: “The problem with her is that she has a big ego and I have great uncertainty if she will ever apologise to the people for her mistakes.”
“Bengalis are a very brave people and they are not going to forgive her unless she apologises to them for the blatant misuse of the state machinery,” he said, describing Ms. Banerjee as “intolerant, whimsical” and behaving in the “most undemocratic manner.”
He had, in his message, suggested that the Chief Minister apologise to the people who had been victimised, insulted, or arrested for expressing dissent against her.
Ms. Banerjee should act in a manner similar to that of the Chief Minister of Maharashtra, Prithviraj Chavan, who had taken action against police officers involved in the arrest of a woman, who had posted comments on Facebook, protesting the shutdown of Mumbai following the passing away of Shiv Sena leader Bal Thackeray.
“I request you to follow this up with the policemen who ordered and implemented the arrest of Professor Ambikesh Mahapatra of Jadavpur University and Shiladitya Chowdhury, and you should immediately withdraw the cases against them and apologise to them,” he wrote.
While Professor Mahapatra was arrested for forwarding an e-mail containing graphics of Ms. Banerjee, Mr. Chowdhury, a farmer, was arrested when he questioned her at a public rally in Belpahari in the State’s Paschim Medinipur district regarding the hike in fertilizer prices.
In the message, Justice Katju also advised Ms. Banerjee to immediately restore Damayanti Sen, an IPS officer, who was transferred from the city police (in connection with investigations in the alleged rape of a woman in Park Street) and apologise to her as well as to Tanya Bharadwaj, a student whom she had “insulted” during a television show.
Describing himself as a “well-wisher” of Ms. Banerjee, he wrote that he wanted her to do well, and there was still time to listen to his advice and change her ways.

COURT TAKES NOTE OF OUTRAGE OVER PALGHAR ARRESTS
It will examine constitutional validity of Section 66A of IT Act
The Supreme Court said on Thursday that the country was outraged when two young women were arrested in Mumbai recently for posting comments on social networking websites, and decided to examine the constitutional validity of Section 66A of the Information Technology Act.
A Bench of Chief Justice Altamas Kabir and Justice J. Chelameswar, entertaining a writ petition that challenged the vires of the provision, asked the Attorney-General to be present in the court on Friday when the matter would be taken up for further hearing. Earlier, senior counsel Mukul Rohatgi pointed to the arrest of the two women and explained how the law was being misused for sharing messages on websites.
In her petition, Shreya Singhal, an aspiring law student, highlighted the incident: Shaheen Dhada, 21, was arrested for questioning the shutdown in the city after the death of a political leader (Shiv Sena chief Bal Thackeray) on Facebook, which was ‘liked’ and shared by her friend Renu Srinivasan, who was also held. When Mr. Rohatgi narrated the incident, the Chief Justice said: “The way the two little girls were arrested, it outraged the people of the country. It needs consideration the way things had taken place so that in future it does not take place.” He also wondered why the girls were taken into custody after sunset for a bailable offence.
